INTERNATIONAL LITIGATION

Appointed international counsel by Phillips, Nizer, Benjamin, Krim and Ballon, Pazer and Epstein P.C. of counsel in multi-million dollar international action against major U.S. and Far Eastern corporations.
*Travelled to India to appear in the High Court in New Delhi.
*Established lines of communication with defendants in India with a view to institution and promulgation of proceedings.
*Set up network of local counsel to secure evidence, research law and co-ordinate similar proceedings in Indian Courts.

Advised as counsel in international credit actions (Europe).

Participated in Great Britain in Union and general litigation concerning setting industry-wide fees and royalty levels in the music and entertainment industry.

Represented lay clients and other attorneys as counsel in pre-trial matters as adviser. Had complete and exclusive conduct of proceedings as settlement negotiator and trial lawyer in original jurisdiction and appellate courts on both sides of the Atlantic. Responsibilities under this head include case assessment, advising on and structuring claims, heads of damage and relief, advising other attornies on formulation of policies and procurement of evidence; advising on evidentiary matters and implementation of advice rendered before courts.

Advised major American law firm on procedures for establishing claim against West German corporation. Researched West German corporate law concerning liability of parent companies, piercing corporate veil, re-incorporation of wholly -owned subsidiaries. Co-ordinated international litigation in supervision of European counsel and supervision of applications to Dusseldorf District Court for leave to institute proceedings and serve on multi-national parent corporation; successfully arranged formal service of proceedings on multi-national parent in West Germany, thus establishing defendant for said proceedings in New York courts. Advised on practical enforceability of U.S. judgments in West Germany.





BANKING AND TAXATION CONSULTANCY

Advised on dissolution of West German and Swiss discretionary trusts and effects of patriation of funds to the United States. Identified, advised on and instituted multi-million dollar litigation suit in New York against major U.S. international bank for breaches of trust and specifically non-authorised speculation with clients funds.

Negotiated and implemented international foreign currency loan agreements.


INTERNATIONAL COMMERCIAL

International relations director and general counsel CASHDISIA STORES LIMITED, a retail, wholesale and industrial apparel distributor in Leeds, England. Responsibilities under this general retainer include:-
*Negotiating real estate agreements in U.K. with major international institutions.
*Assuming day to day responsibility for advising Board of Directors on legal ramifications of proposed corporate actions and on formulation and implementation of policies.
*Directing the development of management consultancy brief and analysing financial statements, thereby achieving turnaround of company from loss to profit situation.
*Travel to three continents; setting up industrial and consumer clothing manufacturing lines in the Far East.
*Establishing supply and distribution network in Hong Kong and China.
*Appointing and supervising agents and local counsel.
*Drafting and implementing international contractual arrangements for export of clothing direct to regional governments utilising contacts established for principals in Vietnam and China.

Represented Brazilian business interests as special counsel in Brazil to investigate possibilities of setting up business consultancy operation in Rio de Janeiro and Sao Paolo. Aims included advising Brazilian companies on and representing such companies in import/export ventures directed towards establishing market penetration for Brazilian goods in the United States, Great Britain and the European Economic Community.

INVESTMENT ANALYSIS & REAL ESTATE CONSULTANCY

HILTON Organisation, New York City. Responsibilities included producing surveys of national and international real estate markets for investment clients
*Prepared and advised on analyses of investments including valuation analysis, outgoings and cash flow figures and projections in the areas of commercial development, residential and industrial investments.

Devised and structured international stand-by letters of credit to cross-collateralise international loan contracts utilising real estate assets and securities to substantiate multi-national transactions.

Appointed by European investment trusts based in Switzerland and a major swiss bank to advise on effects of and establish solutions to problems relating to structuring of investment vehicles to minimise exposure to U.S. statutary taxation and disclosure provisions.
*Devised and implemented the only known workable investment methodology for assisting corporate, institutional and individual investors in eliminating disclosure provisions and removing or significantly reducing liability to real estate gains tax.
